Obtained multiple master plan amendments on behalf of the owner of mixed-use property (retail, office, and residential), to allow development in line with changed market conditions.
Transportation Development. Advise Portland’s regional transportation agency on infrastructure permitting and condemnation.
Represented a residential developer in annexing 70 acres to a smaller city in the Portland metropolitan region.
Assisted an affordable housing developer with 146-unit project in the City of Portland, including land use approvals for adaptive reuse of historic building and associated new development. Defended approval at the local level and at the Land Use Board of Appeals (LUBA).
Assisted an affordable housing developer with entitlements for 57-unit affordable senior housing project in the City of Tigard. Defended approval in appeal to Hearings Officer.
Gorge Regulations. Challenged the U.S. Forest Service’s refusal to allow for a minor boundary line adjustment of two parcels in the Columbia River Gorge National Scenic Area in GLW Ventures, LLC v. Department of Agriculture in federal court and before the Gorge Commission.
Land Use Permitting. Obtained conditional use, design review, partition, property-line adjustment, variance, and other land use approvals to meet client goals for development projects and expanded use of land.
Shoreline Permitting. Successfully challenged the designation of Mill Pond as a regulated water body under the Shoreline Management Act before the Shoreline Hearings Board in Camaslakeland, LLC v. the Department of Ecology. Assisted other clients in obtaining shoreline permits or challenging conditions attached to shoreline permits.
Local and Administrative Land Use Appeals. Represented public and private parties in appeals before local hearings officers, elected officials, and the Land Use Board of Appeals (LUBA).
