Represented landlord against lessee and foreign guarantor regarding break of commercial lease. Secured writ of attachment on guarantor’s real property after guarantor left country and put property on the market. Attachment lien resulted in settlement of lawsuit on highly favorable terms to landlord, rather than the near total loss expected when the matter was initially referred.
Boyer v. Salomon Smith Barney. Our client, a broker-dealer of investment securities and commodities, won a jury verdict after a six-day trial. The case was brought by a commodities trader alleging claims for breach of contract, breach of fiduciary duty, statutory violations, and negligence seeking compensatory and punitive damages for losses incurred in connection with trading contracts for future delivery of crude oil and natural gas. The plaintiff appealed, and the Oregon Court of Appeals split five votes to five. The Oregon Supreme Court unanimously affirmed in favor of our clients, the broker-dealer and its agents.
Prevailed on motion to dismiss former graduate student’s federal lawsuit against private university, which alleged that the university was contractually obligated to award student a doctorate degree.
Advised a professional athlete and a collegiate-level coach form a limited liability company and then subsequently acquire a sports-related franchise business.
Counseled tribe on a tax revenue loan.
Represented numerous parties in navigating regulatory issues involving ownership of cannabis-related businesses, including the structuring, drafting, and vetting of documents with regulators to effect future transfer of ownership interests.
Summary judgment granted on claims of violation of Family and Medical Leave Act and wrongful discharge in violation of public policy on claims against national retail outlet.
Successful resolution of state court insurance coverage recovery action against multiple national and international insurers for a multinational manufacturer named as a potentially responsible party in the ongoing extensive Portland Harbor cleanup. As a part of that proceeding, obtained an antisuit injunction prohibiting insurers from continuing with a duplicative action brought by them in another state seeking a declaratory judgment of no coverage. Coverage was sought for the client under insurance policies of predecessor companies that had owned the client's current Portland facility within the Portland Harbor cleanup study area.
Represented equipment leasing company in claims for negligence arising out of construction accident. Settled at mediation with a complete dismissal of claims against client and reimbursement of 90% of expended attorneys’ fees and costs.
