Assisted nonprofit developer in rehabilitating a historic building and converting it into affordable housing. Advised with respect to structuring the multiple sources of financing. Assisted in negotiations regarding and documentation of bank financing and investment by equity investor.

Feick v. Brutsche, Case No. 54963-8-II (2021). Represent respondents in appeal involving cannabis company in receivership.

Obtained a unanimous jury verdict matching our client’s valuation evidence exactly in a multi-week, 30-party, 100 percent virtual condemnation trial. The local transit authority client needed to acquire the right to amend restrictive covenants to allow it to construct and operate its light rail project and the total valuation dispute was more than $5.5 million in just compensation.

Guided healthcare system through forensic research, repair contracting, preservation of evidence, forensic expert reports, negotiations, and arbitration proceedings for damage claims against the general contractor and subcontractors that improperly performed exterior envelope, plumbing, electrical, and roof work to construct a new hospital for behavioral health patients and required specialty facilities. The entire exterior envelope had to be removed and replaced, together with removal and re-installation of all windows, while the hospital was occupied. After repairs were complete, we prepared, documented, and asserted claims to recover the owner’s damages. Following extensive discovery, depositions, arbitration proceedings, and mediation, we achieved a successful, multimillion dollar recovery of a substantial majority of the owner’s losses.

Represented institutional trustee, acting as a successor trustee and special fiduciary for a financially-incapacitated settlor, in administering trusts that collectively held in excess of $100 million of real property, in litigation and trust administration involving numerous disputes among family member beneficiaries, appraisal and valuation of trust assets, and ongoing management of commercial properties owned by the trusts.

Assisted in drafting Employment Mixed Use Overlay ordinance in Ridgefield, Washington.

Drafted and negotiated multiple office leases to tenants in the tech sector.

Assisted nonprofit developer in developing a multiuse project including commercial space and more than 50 units of affordable senior housing. Advised on structuring the ownership entity and financing. Assisted in negotiation and documentation of equity investment by low-income housing tax-credit investor.

Dempcy v. Avenius, Case No. 79697-6-I (2020). Represented appellant in dispute among neighbors as to rights and responsibilities with respect to common property.
