Court-appointed expert witness in two international software-licensing disputes.
For public and private employers, arbitrated grievance disputes involving discharges, lesser forms of discipline, unsatisfactory work performance, contract violations, duties and assignments, and wages and benefits. Public sector work includes interest arbitrations. Handled numerous unfair labor practice proceeding for public and private employers, involving issues such as arbitrability, deferral, blocking charges, interference, discrimination, bad faith bargaining, unilateral changes, and contract violations.
Negotiate with state agencies for resolution of historic contractual obligation related to off-shore leaseholds.
Negotiated and drafted contract manufacturing agreements and assisted with acquisition of various brands.
Played a leading role in drafting the amicus curiae brief submitted on behalf of 15 tribes in Automotive United Trades Organization v. State of Washington (2015). In a 9-0 decision, the Supreme Court of Washington upheld the constitutionality of tribal-state fuel tax compacts.
Walsh Construction Co. v. Mutual of Enumclaw Insurance Co. Filed successful amicus curiae briefs for Associated General Contractors and others before Oregon Supreme Court to clarify important ruling on Oregon’s anti-indemnification statute governing construction contracts. (2005)
Believing that prevention is best, counseled employers and prepared and presented numerous workshops on remaining union-free even before the union starts organizing. Counseled and represented employers in union organizing efforts in the public and private sectors.
Represented manufacturing client in OSHA administrative action stemming from alleged deficiencies in lock-out /tag-out procedures and protocols. Resulted in a negotiated settlement.
Represents Sound Transit and provides comprehensive guidance on all aspects of eminent domain and inverse condemnation, as well as litigating disputes when they arise. Successfully represented Sound Transit in obtaining settlements in hundreds of condemnation matters in Pierce, King, and Snohomish Counties, including acquisitions for the following light rail links:
