Wyndham Resort Development Corporation et al v. Swinerton Builders Northwest, Inc., et al. Multimillion-dollar recovery in the largest private sector construction-defect case in the history of the state at that time. The case involved claims of negligence, breach of contract, and breach of warranty for multiple types of defects. Representation of The Resort at Seaside against a general contractor and some 28 additional subcontractors, architects, designers, vendors, and material suppliers. Case complexities included dealing with condominium association rights and complex insurance coverage issues.
Drafted series of price agreements and contracts for personal services, architecture and engineering services, and construction services for public bodies.
Transportation Development. Advised Portland’s regional transportation agency on infrastructure permitting and condemnation.
Obtained favorable outcome for a port and railroad company through a settlement based on a suit for breach of contract and warranty arising from purchase of locomotive fleet.
Represented national bank in connection with its purchase of syndicated interests in a global corporation’s business-loan facilities totaling $10 billion.
Full recovery of all damages and almost all costs and attorney fees from shopping mall landlord for project between its tenant and client contractor, involving multiple potential defenses, construction liens, and significant claim amounts.
Member of litigation team that successfully prosecuted claims against the State of California for breach of contract arising from former mining site, resulting in favorable allocation of liability and environmental remediation at the site.
Represented a private equity firm in its acquisition of a technology company.
