Reversal of Major Code Amendments by the City of Portland. Persuaded LUBA and the Oregon Court of Appeals to reverse the City of Portland’s adoption of a major, newsworthy legislative code amendment concerning transportation infrastructure.
Represented local property developer in reverse condemnation issue arising from the state’s efforts to lower heavily trafficked multi-state bridge and negatively impacted the navigability of the Columbia River.
Represented state bank in connection with its purchase of $17 million in tax-exempt bonds and a $3 million taxable bond for the construction of a new affordable-housing complex in Washington.
Client, an independent purchaser of custom products used on public projects, avoided liability when it discovered that the product had not been manufactured as advertised and specified. Client successfully avoided liability using safe harbor provisions of the state’s False Claims Act in a delicate strategy involving the state and several other interested parties.
Assisted public bodies in drafting and approving exemptions to competitive bidding under the Public Contracting Code to allow for use of alternative contracting methods, such as design-build and construction manager/general contractor, on public improvement projects.
Development on Protected Resource Land. Navigated state and local law to gain approvals for construction of residences and establishment of businesses on exclusive farm/forest-use land.

Represented national bank in connection with a $13 million loan for the rehabilitation of affordable housing in Oregon.
Successfully extracted supplier of large hydroelectric turbines from complex federal delay and defect litigation arising from the retrofitting of an existing dam for electrical generation. Guided strategic motion practice and judicial settlement conference to release supplier from virtually all claims, including obtaining payment of supplier's outstanding invoices.
