Gildon v. Simon Property Group, Inc., Case No. 53151-4-I, aff’d in part, reversed in part by 158 Wn.2d 483, 145 P.3d 1196 (2006). Represented petitioner Simon Property Group in case involving unsettled issues under Revised Uniform Partnership Act.
Represented national retail chain in jury trial against claims of sexual orientation discrimination, Equal Pay Act violations, and retaliation; plaintiff sought $426,000, verdict returned for $3,000.
Represented opportunistic real estate fund in objections to plans in Chapter 13 bankruptcy proceedings.
Defended financial institution in “faithless bookkeeper” check case based on common-law conversion and Uniform Commercial Code claims with respect to 570 allegedly unauthorized checks. Case settled in advance of trial after grant of partial summary judgment in favor of client.
Negotiated and developed a strategic alliance agreement for a local manufacturer to partner with an international manufacturer and services business to secure larger, more lucrative contracts.
Assisted client with series of refinances for apartment holdings in Oregon and Washington with debt in excess of $200 million.
Worked with banks and credit unions to review and revise client-facing documentation to make client onboarding and client service more enjoyable, including review of treasury management documents and forms, deposit account agreements, and similar documentation.
Washington State Grange v. Brandt, 136 Wn. App. 138, 148 P.3d 1069 (2006). Represented respondent Washington State Grange in a case involving the application of the rule against perpetuities.
Preparation and successful negotiation of numerous complex master, template, and project-specific design and construction contracts on behalf of healthcare systems, general contractors, subcontractors, architects, and others.
