Revetment Permitting. Successfully obtained permits from local jurisdictions and the Oregon Parks and Recreation Department to place ocean-front protective structures to prevent coastal erosion in front of resorts, commercial properties, and oceanfront homes.
Defended franchisor in federal court action brought by franchisee seeking damages for alleged violations of Washington’s Franchise Investment Protection Act, registration and disclosure violations. Obtained dismissal of franchisee’s claims on summary judgment.
Land Use Permitting. Prepared, negotiated with staff, and obtained approval for all types of land use applications: comprehensive plan amendments, rezones, conditional use permits, site plan review applications, subdivisions, short plats, shoreline permits, development agreements, planning director interpretations, temporary use permits, habitat permits, and wetland permits.
Defended school district against unfair labor practice charges filed with the Washington Public Employment Commission by terminated teacher, resulting in dismissal of charges by hearing examiner. Later affirmed on appeal to the full commission.
Represented City of Seattle in defending against breach of settlement and related claims. Dunn v. City of Seattle, 420 F.Supp.3d 1148 (W.D. Wash. 2019).
Public Records Counsel. Successfully compelled production of public records and blocked the release of confidential records requested under Oregon’s public records laws. Represented clients at all levels of public records disputes, including within the custodian public body, before the district attorney and attorney general, and in court. Developed deep knowledge of Oregon public records laws and strategies to encourage or discourage the release of records.
Represented franchisor in trademark infringement lawsuit. Obtained favorable coexistence agreement with junior user that protected franchisor’s trademark rights.
Legal Lot Determinations. Won several contentious appeals for clients in which jurisdictions have denied the clients historic, buildable lots.
Regularly draft employment agreements and appointment letters, and advise on deferred compensation plans and other employment issues for senior administrators and faculty members.
