Today, President Obama signed into law the Defend Trade Secrets Act. This blog posted an article on the topic last Friday in anticipation of the bill becoming law. The new law takes effect upon enactment ("(e) Effective Date–The amendments made by this section shall apply with respect to any misappropriation of a trade secret (as defined in section 1839 of title 18, United States Code, as amended by this section) for which any act occurs on or after the date of the enactment of this Act."). So a new federal cause of action for trade secret misappropriation that occurs on or after today can be filed in federal court beginning today. All IP and employment lawyers need to get up to speed on this new law asap.
