Represented the successor to a mining company in Idaho in a lawsuit to recover insurance benefits relating to the investigation of contamination at a former mining site. A federal court ruled in favor of our client on summary judgment, finding the insurer jointly and severally liable for all defense costs incurred from the date of first notice of claim.
Tried to defense verdict before a jury a class action suit against petroleum manufacturer in product liability action alleging that defective home heating fuel caused accelerated corrosion in more than 12,000 fuel storage tanks.
Assisted privately held agricultural industry leader with eleven simultaneous Prior Disclosures to Commissioner of Customs covering approximately 27,000 import entries at 33 ports valued at more than $800 million.
Prepared two recent customs petitions for clients experiencing product seizure and penalties, with the result of 100 percent and 90 percent penalty decreases, respectively. One of these results was particularly difficult to obtain because the client had in fact violated registered intellectual property rights with products it had manufactured in China for U.S. sales.
Drafted and advised public port entity on successful multimillion-dollar equipment purchase and custom construction contract with Chinese company, including import and payment issues.
Assists plan sponsors with HIPAA privacy and security compliance, including preparing required notices and advising about HIPAA requirements if a breach occurs.
Reviews and negotiates HIPAA business associate agreements.
Updates privacy and security policies and counsels plan sponsors about complying with individual rights.
