Represented landlord against lessee and foreign guarantor regarding break of commercial lease. Secured writ of attachment on guarantor’s real property after guarantor left country and put property on the market. Attachment lien resulted in settlement of lawsuit on highly favorable terms to landlord, rather than the near total loss expected when the matter was initially referred.
Represented equipment leasing company in claims for negligence arising out of construction accident. Settled at mediation with a complete dismissal of claims against client and reimbursement of 90% of expended attorneys’ fees and costs.
Defended lender in lawsuit alleging that collateral assignment of key man life insurance policy was void. The policy was sole collateral for an otherwise uncollectible five-million-dollar loan. The case ultimately settled with full payment of the policy and complete satisfaction of the loan.
Successfully defended a national bank against lawsuit alleging that bank aided and abetted controlling owner of corporation in perpetuating a Ponzi scheme. Prevailed on the dual grounds that plaintiff failed to show actual knowledge and that the suit was barred due to the owner’s illegal acts by the doctrine of in pari delicto.
Represented buyer of distressed debt from national bank.
Court appointed examiner in In re Archer USA, Inc., U.S. Bankruptcy Court for the Western District of Washington.
Represented Creditors Committee in Trident Water Works.
Represented secured creditor in the sale of assets of an oil company in Chapter 11, subsequently converted to Chapter 7. Objected to the Chapter 11 sale of real property because the creditor did not consent and the price would not satisfy the lien in full. The court denied the motion and converted the case to Chapter 7. Assisted in negotiation and obtained approval of the sale of collateral by the Chapter 7 trustee, resulting in payment of the creditor nearly in full and a large carveout for creditors of the estate.
Represented Nichols Brothers Boat Builders, Inc. in its Chapter 11 reorganization and court approved sale of its business.
