Successful resolution of multimillion-dollar claims and numerous opposing and pass-through claims for CM/GC in a complex, multiparty litigation arising from the reconstruction of the new Sellwood Bridge in Portland. The case was settled through a complex mediation proceeding, with full case presentation, following significant discovery of electronically stored information.
Coauthored Washington State House Bill 2000, which authorized the state to enter into cannabis compacts with Washington tribes. Lobbied for passage of the bill, worked on drafts and amendments of the bill with tribal and state staff.
Judicial Review of Land Use Decisions. Successfully defended local government permit approvals and LUBA decisions before the Oregon Court of Appeals.
Represented seafood company in defending against a state enforcement action for an unauthorized discharge and violations of effluent limitations in its discharge permit.
Multiple cases filed over five years involving defense of siding manufacturer in litigation filed nationwide by national hotel owner against general contractors and product manufacturers. (ESA Mgmt. Inc. v. Dryvit/Sto Corp.)
Coauthored Washington’s inaugural tribal-state cannabis compact, and subsequent other cannabis compacts in Washington.
Assisted private university in drafting and negotiating design and construction contracts for campus expansion.
First-of-Its-kind Planning Goal Exception. Helped obtain first-ever goal exception to Oregon Statewide Planning Goal 18, Implementation Requirement 5, to allow the construction of a beachfront protective structure necessary to prevent the catastrophic loss of prominent resort from bluff erosion.
Represented national grocery store in breach of lease and related claims stemming from environmental contamination at the leased property.
