Platt Electric Supply, Inc. v. Menlo Logistics, Inc. Successful defense of designer of logistical materials plant from multimillion-dollar claims, including recovery of multimillion-dollar counterclaim. After two summary judgment motions and a motion in limine were granted in favor of defendant, Menlo Logistics, Inc., claimed damages were reduced from in excess of $6 million to less than $900,000. Claims included breach of contract, breach of good faith and fair dealing, fraud, and negligent misrepresentation. Menlo Logistics, Inc., obtained summary judgment on claims that, with accrued interest, amounted to in excess of $1.2 million. In the face of claims against it in excess of $6 million, our client, Menlo Logistics, Inc., recovered just under $1 million.

Wyndham Resort Development Corp. v. Swinerton Builders Northwest, Inc. Multimillion-dollar recovery in the largest private-sector construction-defect case in the history of the state at that time for The Resort at Seaside against a general contractor and 28 additional subcontractors, architects, designers, vendors, and material suppliers. Case complexities included dealing with multiple and overlapping defects, language barriers, condominium association rights, and complex insurance coverage issues.

Assisted a local nonprofit in negotiating multilateral construction and property agreements in connection with a complex renovation project in downtown Portland.

Advises Washington-based health care system in contract negotiations with multinational construction company concerning the construction of new hospital facilities in downtown Seattle (ongoing).

Represent leading national architecture firms in contract negotiations for major construction projects and claim disputes.
