The trial involved a dispute over the highest and best use of the property and the court awarded just compensation matching the transit agency’s valuation evidence of more than $1 million less than owner’s just compensation. Resolved intergovernmental conflict between Oregon Employment Department (OED) and Public Employees Retirement System (PERS) by devising the foundational legal theory to allow Oregon public employers to participate in novel federal Work Share program to preserve public employee jobs during the COVID-19 pandemic.

Product Liability, Personal Injury & Tort

Defended commercial engine manufacturer in Washington state-court action involving allegations of breach of implied and express warranties and spoliation in connection with the alleged failure of the engine.

Bankruptcy and Creditors’ Rights

Represented ad hoc committee of secured lenders holding more than $100 million in secured debt in out-of-court restructuring of privately held defense contractor, including representation in connection with debt-for-equity swap, exempt securities issuance, and new debt financing.

Commercial Contract & Tort Litigation

Recovered $15 million in breach-of-contract, successor liability, fraudulent transfer, and corporate piercing action arising out of sale of business.

Appellate Law

Represented broker-dealer in appeal from pretrial dismissal of negligence claims. Oregon Supreme Court concluded that the broker-dealer did not have a special relationship with investor that permitted assertion of tort claims. Boyer v. Salomon Smith Barney, 344 Or 583 (2008)

Represented transit agency in a multi-week condemnation trial. The trial involved a dispute over whether or not the transit agency’s light rail station specially benefited the property due to its proximity and a recent upzone of the property. The jury determined the property was specially benefitted by light rail and returned verdict matching the transit agency’s valuation evidence and $1.4 million less than the owner’s valuation. No fees or costs awarded to property owner. (12-Person Jury Trial)
